General Terms and Conditions (GTC) – “Diemellodge”

  1. Arrival / Departure

Check-in is possible from 3:00 p.m., check-out should be completed by 11:00 a.m. at the latest. A (partial) refund of the rental fee due to early departure is generally not granted. The key will be handed over by the landlord upon arrival.

  1. Special Requests and Side Agreements

These require written confirmation from the landlord. For pets, the type and size must be specified.

  1. Payment

The accommodation fee is due within 14 days of booking. If the 14-day payment deadline is not met, the landlord may withdraw from the contract. Non-payment is considered a cancellation and entitles the landlord to re-rent the property.

  1. Cancellation

You can withdraw from the contract at any time.

The cancellation must be made in writing. In the event of cancellation, the following fees apply:

  • Free cancellation up to 10 days before the start of the rental period
  • 50% of the total amount up to 5 days before the start of the rental period
  • 100% of the total amount from 5 days before the start of the rental period

The date of receipt of your cancellation notice is decisive. Payments already made will be credited. You may provide a substitute person who enters the contract under the stated conditions. A written notification is sufficient.

  1. Tenant Obligations

The tenant agrees to treat the rented items (apartment, inventory, and outdoor facilities) with care. If any damage occurs to the apartment and/or its inventory during the rental period, the tenant is obliged to report this to the landlord immediately. Any defects or damages found upon arrival must also be reported immediately; otherwise, the tenant is liable for them. A reasonable period must be allowed for remedy. Claims based on complaints not reported on site without delay are excluded. Complaints received at the end of the stay or after leaving the apartment are also excluded from compensation.

In the event of service disruptions, the tenant is required to do everything reasonable under legal obligations to help remedy the issue and minimize any potential damage. On the day of departure, personal items must be removed, trash disposed of in designated containers, and dishes cleaned and stored in the kitchen cabinets.

  1. Data Protection

The tenant agrees that personal data necessary for the contract may be stored, changed, and/or deleted. All personal data will be treated with absolute confidentiality.

  1. Liability

The property description has been prepared to the best of our knowledge. No liability is assumed for influence on the rental object by force majeure, local power and water outages, or severe weather. Likewise, no liability is accepted for unforeseeable or unavoidable circumstances such as official orders, sudden construction work, or disturbances caused by natural or local conditions. However, the landlord will assist with problem-solving as much as possible. The landlord is not liable for the use of play and sports equipment provided. Arrival and departure are at the tenant’s own risk. The landlord is not liable for personal items in the event of theft or fire. The tenant is fully liable for any willful damage or destruction.

  1. Final Provisions

Photos and texts on the website or flyers serve as realistic descriptions. A 100% match with the rental property cannot be guaranteed. The landlord reserves the right to make changes to the furnishings (e.g. furniture), as long as they are of equal value.

Should one or more provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision is to be replaced by a valid one that comes closest to the economic and legal intent of the parties. German law applies. Place of jurisdiction and performance is the landlord’s place of residence.
